*Terms and Conditions.
1. In these Terms and Conditions:
(a) Development Victoria agrees to provide front garden landscaping to assist with landscaping of the Land up to a maximum spend of $5,000.
(b) To be eligible for this landscaping, the original purchaser or nominee must:
(i) complete construction of a dwelling on the Lot as evidenced by the issue of an occupancy permit within (2) years of the Date Settlement is Due; and
(ii) present the occupancy permit to the Riverwalk Land Sales Office not more than 28 days from the date of issue of such occupancy permit.
(c) This incentive offer excludes irrigation, steps, pathways, driveway and retaining walls and letterbox, fencing and gates.
(d) Development Victoria must use its reasonable endeavours to ensure that the landscaping works will be undertaken within three (3) months following the presentation of the occupancy permit to the Riverwalk Land Sales Office.
(e) The Purchaser must select a landscape concept design from a range that will be made available by Development Victoria upon the Purchaser or the Nominee presenting the Occupancy Permit to Development Victoria. It is the Purchaser's responsibility to contact local water authorities for information regarding water restrictions.
(f) The Purchaser:
(i) agrees to give the Vendor, Development Victoria and their landscaper and other contractors uninterrupted access to the Property and water supply for the purposes of the landscaping works; and
(ii) acknowledges that the Vendor and Development Victoria are not responsible for any maintenance once the front garden landscaping has been provided by Development Victoria in accordance with this special condition.
In the spirit of reconciliation, Development Victoria respectfully acknowledges the Traditional Custodians of the land on which Riverwalk is being built and developed. We recognise their continuing cultural heritage and connection to land. We pay our respects to their Elders past and present.
